Privacy Act 1988: Australian Privacy Principles

Commercial Bureau Real Estate is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principals (APPs) contained in the Privacy Act 1988.  The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information?
Personal Information is information that can be used to identify you. This may include your name, address, telephone number and email address.  If you are identifiable from the information we collect, it will be considered personal information.

What Personal Information do we collect and hold?
We may collect Personal Information reasonably necessary for our activities as a real estate agent.  This may include your name, address, email address, telephone number, date of birth, occupation, driver’s licence, bank account number and other information which may identify you.

Information which does not enable you or anybody else to be identified, and is therefore not personal information, may also be collected.

How do we collect and hold Personal Information? 
You may provide Personal Information to us through our website or other online presence, by correspondence, telephone, facsimile, email and through our representatives.  We may also collect personal information from publicly available sources and from third parties.  We don’t guarantee the privacy policy of third parties.

Why do we collect Personal Information?
The primary purpose for which we collect your Personal Information is to provide our services to you, provide information to our clients and marketing.  

The secondary purposes for which we collect your Personal Information are closely related to the primary purpose and are where you would reasonably expect such use or disclosure. 

When we collect Personal Information from you, we will where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Access to and correction of your Personal Information
You may access the Personal Information we hold about you and update and/or correct it, subject to certain exceptions.  If you wish to access your Personal Information, please contact us in writing.  XYZ Real Estate will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information, we will require identification from you before releasing the requested information.

Sensitive Information
Sensitive information as defined in the Privacy Act includes information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive information will be used by us only:

  • For the primary purpose for which it was obtained
  • For a secondary purpose this directly related to the primary purpose
  • With your consent; or where required with legal authorisation.  

Disclosure of Personal Information 
Your personal information may be disclosed in circumstances including the following:

  • To third parties where you consent to the use or disclosure; and 
  • Where required or authorised by law.  

Will Personal Information be disclosed to overseas recipients? 
We may disclose Personal Information to our related corporate bodies and third-party service providers located overseas for some of the purposes listed above.  While we take reasonable steps to ensure that overseas recipients do not breach privacy obligations, information overseas is not covered by the Australian Privacy Principles.  The entities outside Australia to which we may disclose Personal Information include the following:
related corporate bodies in India, Hong Kong and China.
our data hosting and other IT service providers located in various countries.
other third parties located in various countries. 

What happens if we can’t collect your personal information? 
If you do not provide requested Personal Information, we may not be able to provide services to you as a client or to you on behalf clients for whom we act.
